A cancellation penalty is not automatic: the landlord must show it is reasonable, considering how quickly the dwelling can be re-let (regulation 5(2)).
Section 14 does not apply if both parties are companies, close corporations or trusts, and may not apply to a private owner who does not let property in the ordinary course of business.
Landlord's expiry reminder is due between 2 November 2026 and 3 January 2027 (CPA s14(2)(c)).
For context: the rent for the rest of the fixed term after 1 December 2026 would be about R26 334. That is not what the tenant owes; a penalty may not cancel out the right to cancel.
General information, not legal advice. KayaPact gives general information and document templates based on the Rental Housing Act, the Consumer Protection Act and related laws. It is not legal advice and does not create a lawyer-client relationship. Laws and your lease may change the answer for your situation: for disputes, speak to the Rental Housing Tribunal in your province, a Rental Housing Information Office, Legal Aid South Africa or an attorney. Whether the Consumer Protection Act applies depends on who the landlord and tenant are; see the FAQ.
The landlord's expiry reminder
Between 80 and 40 business days before a fixed-term lease ends, the landlord must tell the tenant in writing that it is ending, of any changes for a renewal, and of the tenant's options (CPA s14(2)(c)). If nothing is done, the lease continues month to month.
Cancellation is not eviction
A cancelled lease does not let the landlord change the locks or cut the power. Read the eviction overview.
Frequently asked questions
How much notice must a tenant give to end a fixed-term lease early?
Where the Consumer Protection Act applies, 20 business days' notice in writing, at any time (s14(2)(b)(i)(bb)). The tenant still owes rent up to the cancellation date and may face a reasonable cancellation penalty.
What counts as a business day?
Any day except Saturday, Sunday or a public holiday. The day the notice is given is not counted, and the last day is (CPA s2(6)).
What is a reasonable cancellation penalty?
There is no fixed amount. Regulation 5(2) lists factors, including what the tenant still owes, the length of the lease, how much notice was given, and how easily the landlord can find a new tenant. A penalty may not be so high that it cancels out the right to cancel (reg 5(3)). Factors include: what the tenant still owes up to the cancellation date; the value of the lease up to cancellation; the length of the lease as originally agreed; losses or benefits to the tenant from the lease.
Can a landlord cancel because the rent is late?
The landlord must first give written notice of the breach. If the tenant does not fix it within 20 business days, the landlord may cancel (s14(2)(b)(ii)). Even then, only a court can order the tenant out.
Does the CPA apply to my lease?
It applies where the landlord lets in the ordinary course of business and the tenant is a consumer. Section 14 does not apply if both parties are juristic persons (companies, close corporations or trusts). Whether a private owner letting a single flat is covered is debated; if in doubt, follow the lease and get advice.
What about a month-to-month lease?
Either party can end it with at least 1 month's written notice (Rental Housing Act s5(5)), unless the lease gives longer.
